terms of use

1. About These Terms

This website, karissajohnsonphotography.com, is owned and operated by Karissa Johnson Photography, a photography business based in Fort Saskatchewan, Alberta, Canada.

These Terms of Use govern your access to and use of this website. By browsing the site, submitting a form, or otherwise interacting with it, you agree to be bound by these terms. If you do not agree, please do not use the site.

These terms apply to the website only. Photography services are governed by the separate Photography Agreement, which is signed before every booking and sets out all terms relating to sessions, payment, delivery and image use.

2. Inquiries are Not a Booking

Nothing on this website constitutes an offer to enter into a contract for photography services. Prices, packages and availability shown here are for information only and may change at any time without notice.

Submitting a contact form or questionnaire does not reserve a date or create a booking. A booking exists only once a Photography Agreement has been signed and any required retainer has been received.

3. Intellectual Property

All content on this website, including photographs, images, text, graphics, logos and design, is the property of Karissa Johnson Photography and is protected under the Copyright Act (Canada) and applicable international copyright law.

You may view this website for your own personal, non-commercial reference. You may not:

  • Copy, reproduce, republish, distribute, or publicly display any photograph or other content from this site without written permission.
  • Download, save, screenshot, capture, or otherwise store any photograph or other content from this site to any device or storage medium, for any purpose.
  • Use any content for commercial purposes, including in advertising, resale, or promotional material.
  • Use any content to train, fine-tune, or otherwise develop artificial intelligence (AI) or machine learning systems.
  • Systematically scrape, harvest, or extract content from this site by automated means.
  • Use any photograph or image from this site to create, generate, alter, or synthesize new images or media using artificial intelligence, including face-swapping, “deepfakes,” or any sexually explicit, intimate, or otherwise altered depiction of any real, identifiable person.
  • Alter or remove any copyright notice, watermark, or attribution.

The Karissa Johnson Photography name and logo may not be used without written permission.

Creating, altering, or distributing an intimate image of a real, identifiable person without their consent — including an image created or altered using artificial intelligence — may constitute a criminal offence under Canadian law, in addition to civil liability. We take any violation of this section seriously and reserve the right to pursue all available legal remedies, including reporting suspected criminal conduct to law enforcement.

Client photography galleries are delivered separately through our secure ShootProof platform under the terms of your Photography Agreement; no images on this website are made available for client or public download.

4. Acceptable Use

You agree to use this website lawfully and not to:

  • Use the site in a way that breaches any applicable federal, provincial, or municipal law.
  • Attempt to gain unauthorized access to the site, its server, or any connected system.

  • Interfere with the normal operation of the site or place unreasonable load on it.
  • Submit false, misleading, abusive, or unlawful information through any form on the site.

5. Information You Submit

When you submit a contact form or session questionnaire, the information you provide is sent to us by email and stored on this website. Please only submit information that is accurate and that you are entitled to provide.

By submitting an inquiry you consent to us contacting you by email in response. Under Canada’s Anti-Spam Legislation (CASL) we will only send you commercial electronic messages where we have your consent or are otherwise permitted to do so, and every such message will include a way to unsubscribe.

How we collect, use and protect your personal information is set out in our Privacy Policy, which is written to comply with Alberta’s Personal Information Protection Act (PIPA) and Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA).

8. Accuracy & Availability

We make reasonable efforts to keep this website accurate and up to date, but content is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

We do not warrant that the site will be uninterrupted, error free, or free of viruses, and we may change, suspend or withdraw any part of the site at any time without notice.

12. Governing Law

These Terms of Use are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in that province. You agree to the exclusive jurisdiction of the courts of Alberta for any dispute arising from your use of this website.
